If you fulfill one of other conditions, ex. you work in Poland, do own business, study – you can apply for next resident permission. Unfortunately after divorce you will not get settlement permission. Moreover you can get resident permission because of yours child which live in Poland and has polish or eu citizenship – this is special circumstance.

For temporary resident permission you can apply when you start study in Poland and have: health insurance and reliable source of income (ex. scholarship, salary).

he best option for You is to apply for temporary resident permission (for 2 years). You can do it, if your husband has got settlement permission in Poland or long-time EU resident permission or he got temporary resident permission and stay in Poland at least 2 years. Before you get permission polish administrative power check, if your marriage is real – you didn't contract yours marrage only for get resident permission in Poland. For that you will ask, if you lived together before you moved to Poland, you known each other and speak the same language, etc.

Hi, I am from India. I have registered a company(Sp.z.o.o) in Poland in 2006. I got the documents like KRS, REGON .I submitted the documents to the poland embassy in India.Then I got work visa till 30th nov 2007. In Polish law, possibility of getting an extansion of visa, is possible only in particular situation. Art. 43 of the Polish act about foreigners states, that foreigner, who stays in Poland, can get an extension of visitor's visa, if there particular conditions are fulfilled:
- it is necessary to support the foreigner's important occupational business or personal business or humanitarian reasons;
- event, which is the cause of applying for the extension, appears without reference to foreigner’s will and it couldn’t be anticipated, when the proper authority issued the visa;
- circumstances don't indicate, that an aim of stay in Poland is different from the aim, which was announced earlier;
- there aren't fulfilled other circumstances, which are indicated in art. 42 pkt 2-7;
All conditions have to be fullfiled together.
The time of stay in Poland on the basis of prolonged visa can't be longer than time of stay, which is indicated in this type of visa. Usually, an extension is used in cases of stying in a hospital or in situation caused by nature. Essential condition is staying in Poland at the moment of applying for an extension. Decision about extension is issued by voivode and it can be issued only once. The foreigner has to put a motion about extension at least 7 days within time limit indicated in short term visa or at least 14 days within time limit indicated in long term visa. If above circumstances aren’t fulfilled, You can only apply for next vistor's visa. Then You should file all documents, which You filed when You was applying for previous visa.

Art. 53 ust. 2 of the Polish act about foreigners states that temporary residence permit can be given to foreigner, who is married with Polish citizen. According to the art. 55 of the same act: Licensing authority, which conducts a procedure, investigates if contracting a marriage hasn’ t been a way to to evade the law. Investigation is carried, when there are fulfilled some circumstances:
- one of spouses got a benefit in return for contracting a marriage, unless this was a result of prevalent custom in a country or social group;
- spouses don't execute legal duties which are the result of contracting a marriage;
- spouses don't live together;
- spouses hadn't met before the marriage was contracted;
- spouses don't speak in a language which is comprehensible to both of them;
- spouses aren't unanimous about personal data and other relevant circumstances which are related to them;
- one of them or both of them contracted fake marriages in the past.
If licensing authority states that contracting a marriage was a way to evade the law, permission won't be given. But in Your situation, when You has a daughter with Polish citizen, it shouldn’t be any problems with getting permit. Such permission is issued for 2 years, which can be extended but, every time no longer than to 2 years. You should submit application to the appropriate administrative power, which is voivode of voivodeship, of your current place of living (the application should be available on the web site of every Voivodehip Office).A foreigner, who stays out of Poland, submits application by hand of Consul. If You want to apply for temporary residence permit (permission on time meant), You have to deliver:
- 4 copies of application, which should be filled up in accordance with instruction (application form should be available on the web site of every Voivodehip Office);
- 4 present photos 4,5 x 3,5 cm – photos should present a person without headdress or dark glasses; they also should show left half-profile with visible left ear and they should be taken with regular face lightening;
- Valid passport (2 copies);
- Confirmation of temporary registration.
In addition, in case of contraction a marriage You should deliver:
- Present duplicate of marriage certificate;
- Copy of Your spouse’s identification card.

t's not necessary to be Polish citizen to send an invitation letter. But there is a special formula of invitation letter which Your friend can get from an appropriate authority. Inviting person has to give basic information about herself (including identity document). The most important thing is, that the inviting person must agree to cover the living cost and the departure cost of the invited foreigner, including the cost of medical treatment as well the cost of deportation from Republic of Poland. This person must also complete the application to enter the invitation into the invitation register. The application should be completed in Polish language. There need to be: data, place of residence or seat, identity document, financial situation and accommodation of the inviting person.

We have allready put application in to the court for marry but still we did\'nt get any responce from court. Your stay card is a document which sates your origin and declares getting residency permit on time meant, which was given to you, in order to study and live in the territory of Poland legally. Within 45 days before the duration of validity, indicated in your stay card, is over, you should submit with the application to the appropriate administrative power, which is voivode of voivodeship of your current place of living, in order to get residency permit on time meant, if you want to stay in Poland legally. First of all, you cannot apply for the Polish passport because you are not the Polish citizen, but if you would like to move to Poland, you are supposed to apply for visa, which is issued by the Polish consul. The type of visa you will get is dependent on the aim of your journey, indicated in the application. In your case, you can apply for entry or visitor's visa. This first type gives you an opportunity to cross the boarder only once, and it can be given to a foreigner, who before crossing the boarder or in the moment of crossing the boarder, got the other legal title to stay in the territory of Poland. The duration of validity of this visa is one year during which one should cross the boarder. This type of visa is also issued in order to realise the permission on time meant, settlement permit but under the condition of getting the permission to cross the border. There are two types of visitor’s visa: short-term visa and long-term visa. Short term visa gives you a right to: entry and stay in the territory of Polish Republic, premanently (without intermissions) or, a few stays, in which one follows another, and all together last no longer than:
-3 months, during the six month period, since the first day of entrance (short-term visa)
-1 year, during the duration of validity of visa (long-term visa)
Long term visa can be issued for longer than 3 months, in such cases as: visiting, running your own business, or working. -foreigner started education at one of the Polish universities.
The next step would be to get settlement permit, which is issued for non-defined period, after fulfilling appropriate requirements, and which can be the base for applying for Polish citizenship.

There isn't other requirements beyond above mentioned by You. Unfortunately resident visa is giving only for 1 year, so before it's expired You must apply for extension of your resident visa. Right administrative power is polish Consul. After You get in Poland You must register in right office (city hall).

I am an American citizen and I married a Polish girl in America. As she was getting her green card I moved to Poland and started the process of becomming a citizen. You can get next temporary life permission, if after divorce You will have got very important reasons to stay in Poland. There isn't legal definition of "very important reasons" so each appliaction is consider individually.
